Privacy policy

Last Updated: July 24, 2026

This Privacy Policy describes how Souljay (“Souljay,” “we,” “us,” or “our”) collects, uses, discloses, and otherwise processes personal information when you visit https://www.souljay.com/ (the “Site”), place an order, contact us, or otherwise interact with our online store and related services (collectively, the “Services”).

Please read this Privacy Policy carefully. By using the Services, you acknowledge that you have reviewed this Privacy Policy. If you do not agree with our privacy practices, you should discontinue use of the Services.

1. Scope and Business Identity

Souljay is an independently operated online women’s fashion store based in Lake Stevens, Washington, United States. We primarily serve customers throughout the United States.

For purposes of applicable privacy laws, Souljay may act as the business or controller responsible for the personal information described in this Privacy Policy. Certain service providers, payment providers, and other third parties may separately determine how they process information under their own privacy policies.

This Privacy Policy applies to information processed through Souljay’s Site and customer interactions. It does not control the independent privacy practices of third-party websites, payment providers, shipping carriers, social media platforms, or other services that Souljay does not own or control.

2. Personal Information We Collect

The personal information we collect depends on how you interact with Souljay and which features or services you use.

We may collect the following categories of personal information:

  • Contact information: Your name, email address, telephone number, billing address, shipping address, and other contact details.
  • Order and transaction information: Products viewed or purchased, selected size or color, order number, order value, discounts, payment status, shipment information, tracking information, returns, refunds, and transaction history.
  • Payment-related information: Payment method, billing details, transaction identifiers, payment authorization status, and limited payment information made available by the applicable payment provider. Complete payment card details are processed by payment providers rather than stored directly by Souljay.
  • Account information: Login credentials, saved addresses, account preferences, and order history if customer account features are available and used.
  • Customer service information: Messages, questions, complaints, return requests, refund inquiries, photographs, product issue reports, and other information submitted when contacting us.
  • Device and technical information: Internet Protocol address, browser type, device type, operating system, time zone, language, general location derived from an IP address, referring URLs, and technical identifiers.
  • Site activity information: Pages viewed, links selected, products searched for, shopping cart activity, checkout activity, session duration, and interactions with Site features.
  • Marketing and preference information: Email subscription status, communication preferences, advertising interactions, and information about how you respond to marketing communications.
  • Fraud prevention and security information: Information used to verify transactions, identify suspicious activity, protect accounts, and prevent fraud, abuse, or unauthorized purchases.
  • Content submitted by you: Reviews, feedback, survey responses, photographs, or other content you voluntarily provide, where these features are available.
  • Information derived from other information: Preferences or likely interests inferred from shopping activity, product interactions, or marketing engagement, where these practices are enabled.

Please do not send Souljay Social Security numbers, government identification numbers, complete payment card numbers, card security codes, account passwords, precise financial account credentials, or other highly sensitive information unless we specifically explain why the information is necessary and provide appropriate instructions.

3. Sources of Personal Information

We may collect personal information from the following sources:

  • Directly from you: When you browse the Site, place an order, create an account, subscribe to marketing, contact customer support, request a return, or submit other information.
  • Automatically through the Services: Through cookies, pixels, log files, local storage, and similar technologies when you use the Site.
  • From Shopify: Shopify provides the ecommerce platform, checkout infrastructure, order-management tools, and related services used to operate our store.
  • From payment providers: Such as card processors, PayPal, Shop Pay, Apple Pay, Google Pay, and other payment services selected during checkout.
  • From shipping and fulfillment providers: Such as carriers and other providers involved in processing, dispatching, tracking, and delivering orders.
  • From analytics and advertising partners: Including services provided by Google, Pinterest, or other partners where their services, sales channels, tags, pixels, or analytics tools are enabled.
  • From fraud prevention and security providers: When necessary to verify a transaction, identify suspicious behavior, or protect the Services.
  • From publicly available or legally permitted sources: Where obtaining and using the information is permitted by applicable law.

4. How We Use Personal Information

We may use personal information for the following purposes:

  • Operating, maintaining, and improving the Site and Services
  • Processing payments and confirming transactions
  • Processing, fulfilling, shipping, and tracking orders
  • Providing order confirmations, shipping updates, return information, and refund notifications
  • Responding to product, sizing, order, payment, shipping, return, refund, privacy, or customer service inquiries
  • Reviewing damaged, incorrect, defective, or quality-related item reports
  • Maintaining customer accounts and saved preferences, where applicable
  • Detecting, investigating, and preventing fraud, unauthorized transactions, abuse, security incidents, and policy violations
  • Maintaining business, accounting, tax, transaction, and customer service records
  • Understanding how customers use the Site and evaluating Site performance
  • Improving product presentation, store navigation, customer support, and shopping experiences
  • Personalizing content, product recommendations, or advertising where enabled and permitted
  • Sending marketing communications in accordance with customer preferences and applicable requirements
  • Enforcing our policies, agreements, and legal rights
  • Complying with applicable laws, regulations, legal processes, and governmental requests
  • Protecting the rights, safety, property, and security of Souljay, our customers, and others

5. Legal Grounds for Processing

Where applicable law requires a legal basis for processing personal information, Souljay may process information on one or more of the following grounds:

  • Performance of a contract: Processing necessary to accept payment, fulfill an order, arrange delivery, process a return, or provide requested customer service.
  • Legitimate interests: Processing necessary to operate and improve the store, prevent fraud, protect security, maintain records, and understand business performance, provided those interests are not overridden by applicable individual rights.
  • Consent: Processing based on permission, such as certain marketing communications, advertising technologies, or non-essential cookies where consent is required.
  • Legal obligations: Processing necessary to comply with tax, accounting, consumer protection, law-enforcement, or other legal requirements.
  • Protection of rights and safety: Processing necessary to establish, exercise, or defend legal claims or protect the rights and security of Souljay, customers, and others.

Where processing is based on consent, you may withdraw that consent as permitted by applicable law. Withdrawal does not affect processing that occurred before consent was withdrawn or processing permitted on another lawful basis.

6. Payment Information

Payments are processed through Shopify and the payment provider selected during checkout. Available providers may include credit and debit card processors, PayPal, Shop Pay, Apple Pay, and Google Pay.

Souljay does not store a customer’s complete credit or debit card number on its own systems. Payment providers may collect and process payment credentials, billing information, device information, transaction details, and fraud-prevention information under their own terms and privacy policies.

Limited payment information, such as payment method, transaction status, billing details, transaction identifiers, and the last digits of a payment card, may be made available to Souljay for order administration, fraud review, refunds, customer support, accounting, and legal compliance.

7. Cookies and Similar Technologies

Souljay, Shopify, and applicable service providers may use cookies, pixels, tags, software development tools, local storage, and similar technologies to operate the Site and understand how it is used.

These technologies may be used for:

  • Essential functions: Maintaining Site security, remembering cart contents, supporting checkout, preventing fraud, and enabling core Site functions.
  • Functional purposes: Remembering preferences and improving Site functionality.
  • Analytics: Measuring Site traffic, usage, performance, and customer interactions.
  • Advertising and personalization: Measuring advertising performance, understanding marketing activity, and presenting more relevant content or advertising where enabled.

You can manage certain cookies through your browser settings and through any privacy controls or cookie banner made available on the Site. Blocking essential cookies may prevent some parts of the Site, including cart or checkout functions, from working correctly.

Browser and device controls vary. Disabling a cookie does not necessarily remove information previously collected, and it may not prevent all forms of measurement or tracking.

8. Analytics, Advertising, and Sales Channels

Where enabled, Souljay may use analytics, advertising, and sales-channel services to measure Site activity, display products, understand marketing performance, and present relevant advertising.

These services may include tools or integrations provided by Shopify, Google, Pinterest, and other advertising or analytics providers. Such providers may collect device identifiers, IP addresses, cookie identifiers, browsing activity, product interactions, checkout events, and purchase information according to their own privacy terms and the Site’s configured privacy settings.

Depending on applicable law, certain disclosures to advertising partners may be considered “selling,” “sharing,” or processing for “targeted advertising,” even when no money is exchanged for the information.

9. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients when reasonably necessary for the purposes described in this Privacy Policy:

  • Shopify: To host and operate the online store, checkout, order management, fraud prevention, analytics, and related ecommerce services.
  • Payment providers: To authorize, process, verify, refund, and protect payment transactions.
  • Shipping, fulfillment, and logistics providers: To prepare, transport, track, deliver, return, and investigate shipments.
  • Customer service and communications providers: To respond to inquiries and deliver order, support, and marketing communications.
  • Analytics and advertising providers: To measure Site activity, analyze performance, manage campaigns, and provide advertising where enabled.
  • Security and fraud prevention providers: To verify transactions and prevent fraud, abuse, unauthorized access, or security incidents.
  • Professional advisers: Such as accountants, legal advisers, insurers, auditors, and consultants when reasonably necessary.
  • Governmental, regulatory, or legal authorities: When disclosure is required or permitted by law, legal process, court order, or a valid governmental request.
  • Parties to a business transaction: In connection with a proposed or completed sale, transfer, financing, reorganization, or other change involving all or part of the store, subject to appropriate requirements.
  • Other parties at your direction or with your consent: When you request, authorize, or consent to the disclosure.

Service providers are permitted to process information only as allowed by their agreements, their independent legal obligations, or applicable law.

10. Sale, Sharing, and Targeted Advertising

Souljay does not sell personal information for money as a standalone business practice.

However, some privacy laws define “sale” or “sharing” broadly enough to include certain disclosures of identifiers, cookie information, or Site activity to advertising and analytics partners for interest-based or targeted advertising.

Depending on your location and applicable law, you may have the right to opt out of:

  • The sale of personal information
  • The sharing of personal information for cross-context behavioral advertising
  • The processing of personal information for qualifying targeted advertising

You may submit an applicable opt-out request through the “Do Not Sell or Share My Personal Information” link available in our website footer.

You may also email hello@souljay.com with the subject line “Privacy Opt-Out Request.” Please provide enough information for us to identify and process the request.

Where required by applicable law and supported by the Site’s privacy tools, recognized browser-based opt-out preference signals, including Global Privacy Control, may also be processed.

The footer link and related privacy controls must remain available and functional in each region where Souljay is required or has chosen to provide an applicable opt-out mechanism.

11. Marketing Communications

If you choose to receive marketing communications, Souljay may send information about products, promotions, store updates, or related content.

You can unsubscribe from marketing emails by using the unsubscribe link included in an applicable marketing message or by contacting hello@souljay.com.

Unsubscribing from marketing communications will not prevent Souljay from sending transactional or service-related messages concerning an order, payment, shipment, delivery, return, refund, security issue, policy update, or customer service request.

12. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing the Services, maintaining transaction and tax records, processing returns and refunds, resolving disputes, preventing fraud, enforcing agreements, and complying with legal obligations.

The applicable retention period may depend on:

  • The type and sensitivity of the information
  • The purpose for which the information was collected
  • The duration of the customer relationship
  • Legal, accounting, tax, contractual, and reporting requirements
  • Fraud prevention, security, complaint, dispute, or litigation needs
  • Whether the information can be safely deleted or anonymized

Certain order, transaction, tax, accounting, refund, dispute, and fraud-prevention records may be retained for up to seven years where reasonably necessary or required to satisfy applicable tax, accounting, audit, legal, or recordkeeping obligations.

Some records may be retained for a shorter period, while other records may need to be retained longer when required by applicable law, an unresolved dispute, a legal hold, fraud prevention, or another legitimate obligation.

When information is no longer reasonably required, it may be deleted, anonymized, or retained in a restricted form as permitted by applicable law.

13. Data Security

Souljay uses reasonable administrative, technical, and organizational measures intended to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

Payments are processed through Shopify and applicable payment providers rather than by storing complete payment card information directly on Souljay’s own systems.

No method of transmitting information over the Internet or storing information electronically can be guaranteed to be completely secure. Customers should protect account credentials, use unique passwords, and notify Souljay if they suspect unauthorized activity involving an order or customer account.

14. Your Privacy Rights

Depending on your location and applicable law, you may have some or all of the following rights:

  • Request confirmation of whether we process your personal information
  • Request access to personal information we maintain about you
  • Request correction of inaccurate personal information
  • Request deletion of certain personal information
  • Request a portable copy of certain personal information
  • Opt out of qualifying sale, sharing, or targeted advertising
  • Withdraw consent where processing is based on consent
  • Limit certain uses or disclosures of sensitive personal information where applicable
  • Appeal a decision concerning a privacy request where applicable
  • Receive information about categories of personal information, sources, purposes, and recipients

These rights are not absolute. A request may be limited or denied when an exception applies, such as when information must be retained to complete a transaction, maintain legally required records, prevent fraud, protect security, resolve a dispute, or comply with law.

Souljay will not unlawfully discriminate against a customer for exercising an applicable privacy right.

15. How to Submit a Privacy Request

To submit a privacy request, email hello@souljay.com with the subject line “Privacy Request.”

Please include:

  • Your full name
  • The email address associated with your interactions or orders
  • The type of privacy request you are making
  • Sufficient information to help us identify the relevant records

We may need to verify your identity before completing a request. Verification information will be used only to evaluate and process the request.

Do not send a Social Security number, complete payment card number, account password, or unnecessary government identification with an initial request.

Where permitted by applicable law, an authorized agent may submit a request on your behalf. We may request evidence that the agent has authority to act for you and may verify your identity directly.

We will respond within the timeframe required by applicable law. If we deny or limit a request, we will provide an explanation when legally required.

16. U.S. State Privacy Notice

Residents of certain U.S. states may be entitled to additional disclosures and rights under applicable state privacy laws.

Depending on how a customer interacts with the Services, Souljay may collect the following general categories of personal information:

  • Identifiers and contact information
  • Customer records and billing information
  • Commercial and transaction information
  • Internet or electronic network activity
  • Approximate location derived from an IP address
  • Customer service communications and submitted content
  • Preferences or inferences derived from Site interactions
  • Limited sensitive information necessary to process payments or provide requested services

These categories may be disclosed to the service-provider and third-party categories described in this Privacy Policy for operational, payment, fulfillment, security, analytics, advertising, legal, and customer service purposes.

Souljay does not knowingly use sensitive personal information to infer characteristics about customers in a manner subject to a right to limit under applicable law.

17. Children’s Privacy

The Services are not directed to children under 13 years of age, and Souljay does not knowingly collect personal information directly from children under 13.

If you are a parent or legal guardian and believe that a child has provided personal information to Souljay, please contact us at hello@souljay.com so that we can review the request and take appropriate action.

18. International and Cross-Border Processing

Souljay is based in the United States. Shopify and other service providers may process or store personal information in the United States, Canada, or other countries where they or their service providers operate.

Privacy and data protection laws in those locations may differ from the laws in your location. Where required, applicable providers may use legally recognized safeguards for international data transfers.

19. EEA, United Kingdom, and Switzerland Privacy Rights

If you are located in the European Economic Area (“EEA”), the United Kingdom (“UK”), or Switzerland, and applicable data protection law applies to Souljay’s processing of your personal information, you may have additional rights.

Subject to applicable conditions and exceptions, these rights may include:

  • The right to request access to your personal information
  • The right to request correction of inaccurate or incomplete information
  • The right to request deletion of certain personal information
  • The right to request restriction of certain processing
  • The right to object to processing based on legitimate interests or direct marketing
  • The right to receive certain information in a portable format
  • The right to withdraw consent where processing is based on consent
  • The right to lodge a complaint with an applicable data protection authority

Withdrawing consent does not affect the lawfulness of processing performed before consent was withdrawn.

Personal information may be transferred from the EEA, UK, or Switzerland to the United States, Canada, or other locations where Shopify and applicable service providers operate. Where required by applicable law, the relevant party may rely on recognized safeguards or another lawful transfer mechanism.

To submit an applicable privacy request, contact hello@souljay.com with the subject line “Privacy Request.”

20. Third-Party Websites and Services

The Site may contain links to third-party websites, social media services, payment providers, or other external services.

Souljay is not responsible for the privacy, security, accuracy, or content practices of third-party services. We encourage customers to review the privacy policy of each third party before providing personal information.

Privacy requests relating to information independently maintained by Shopify, PayPal, Apple, Google, Pinterest, a bank, a shipping carrier, or another third party may need to be submitted directly to that provider.

21. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to our Services, technologies, providers, business practices, legal obligations, or other operational requirements.

When the policy is updated, the revised version will be posted on this page and the “Last Updated” date will be changed. Where required by applicable law, we may provide additional notice of material changes.

If you have a question, concern, or complaint about Souljay’s privacy practices, please contact us using the information below.
